1. Definitions

For the purposes of these Terms and Conditions:

  • "Service" refers to the corporate housing and property rental services provided by Amberveil
  • "We", "Us", "Our" refers to Amberveil, the service provider
  • "You", "Client", "Tenant" refers to the individual or entity entering into a rental agreement
  • "Property" refers to any residential accommodation managed or provided by Amberveil
  • "Agreement" refers to the binding rental contract between Amberveil and the Client
  • "Website" refers to ambervac.pro and all associated pages

2. Acceptance of Terms

By accessing our website, making an inquiry, or entering into a rental agreement with Amberveil, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Amberveil. You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services.

3. Service Description

Amberveil provides corporate housing rental services in Malaysia, including but not limited to:

  • Furnished apartment and villa rentals
  • Property management and coordination
  • Maintenance and housekeeping services (where specified)
  • Check-in support and local information

Service availability is subject to property inventory and booking schedules. We reserve the right to modify or discontinue any service at our discretion, though we will provide reasonable notice to existing clients when possible.

Property descriptions, photographs, and amenities listed on our website are accurate to the best of our knowledge at the time of publication. However, minor variations may occur, and we recommend viewing properties in person or via virtual tour before committing to a rental.

4. Rental Agreements

4.1 Booking and Confirmation

To secure a property, you must submit a completed rental application and pay the required deposit. Bookings are confirmed upon our receipt of the deposit and execution of the rental agreement by both parties. Verbal agreements or email confirmations are not binding until formalized in a signed rental contract.

4.2 Rental Period

Minimum rental periods vary by property type as specified in individual rental agreements. Standard terms are one month for city-edge apartments, three months for resort-style condominiums, and six months for hilltop retreats. Extensions or early termination must be negotiated in writing with advance notice as stipulated in your agreement.

4.3 Payment Terms

Rent is payable monthly in advance. Payment methods include bank transfer, credit card, or other approved methods. A security deposit equivalent to one or two months' rent is required and will be refunded within 30 days of check-out, subject to property inspection and deduction of any damages or outstanding charges.

4.4 Late Payment

Late payment may result in suspension of services and termination of the rental agreement. A late fee may be charged as specified in your rental contract.

5. Client Responsibilities

5.1 Property Care

You agree to:

  • Maintain the property in good condition
  • Use furnishings and appliances responsibly
  • Report damage or maintenance issues promptly
  • Follow building rules and regulations
  • Not make unauthorized modifications or alterations

5.2 Occupancy Limits

Properties must not be occupied by more individuals than specified in the rental agreement. Subletting or allowing third parties to use the property without written permission is strictly prohibited.

5.3 Prohibited Activities

The following activities are not permitted:

  • Illegal activities of any kind
  • Smoking in non-smoking properties
  • Keeping pets without written authorization
  • Causing disturbances to neighbors or other residents
  • Commercial activities unless specifically agreed

5.4 Insurance

We strongly recommend that tenants obtain personal property insurance. Amberveil is not responsible for loss or damage to your personal belongings.

6. Our Responsibilities

Amberveil commits to:

  • Provide properties that meet described standards and specifications
  • Ensure properties are clean and functional at check-in
  • Address maintenance requests within reasonable timeframes
  • Respect your privacy and provide quiet enjoyment of the property
  • Maintain common areas and building infrastructure (where applicable)

We may enter the property with reasonable notice (except in emergencies) for inspections, repairs, or to show the property to prospective tenants during the notice period.

7. Cancellation and Termination

7.1 Cancellation Before Check-In

Cancellations made more than 30 days before the scheduled check-in date will receive a refund of the deposit minus an administrative fee. Cancellations within 30 days of check-in may result in forfeiture of the deposit or partial monthly payment, as detailed in your rental agreement.

7.2 Early Termination by Tenant

If you wish to terminate the agreement before the contracted end date, you must provide written notice as specified in your rental contract (typically 30 or 60 days). Early termination fees may apply as outlined in your agreement.

7.3 Termination by Amberveil

We reserve the right to terminate the rental agreement immediately if you:

  • Fail to pay rent or other charges
  • Violate these Terms and Conditions
  • Engage in illegal activities on the property
  • Cause significant damage to the property
  • Breach building regulations or disturb other residents

7.4 End of Tenancy

At the end of the rental period, you must vacate the property in the same condition as received (normal wear and tear excepted), return all keys and access cards, and settle all outstanding charges. A final inspection will be conducted to assess any deductions from the security deposit.

8. Maintenance and Repairs

We will address maintenance issues within the following timeframes:

  • Emergency repairs (safety hazards, major leaks): within 24 hours
  • Urgent repairs (non-functioning appliances, heating/cooling issues): within 48 hours
  • Non-urgent repairs: within 5 business days

You are responsible for reporting maintenance needs promptly. Damage resulting from your negligence or misuse will be charged to you. Routine maintenance costs are covered by us; tenant-caused damage is your responsibility.

9. Liability and Indemnification

9.1 Limitation of Liability

Amberveil's liability is limited to direct damages proven to be caused by our negligence. We are not liable for indirect, incidental, or consequential damages including but not limited to lost profits, business interruption, or personal inconvenience.

9.2 Maximum Liability

Our maximum aggregate liability under any rental agreement shall not exceed the total rent paid during the rental period.

9.3 Tenant Indemnification

You agree to indemnify and hold harmless Amberveil, its owners, employees, and agents from any claims, damages, or expenses arising from your use of the property, violation of these terms, or infringement of any third-party rights.

9.4 Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, public health emergencies, or infrastructure failures.

10. Dispute Resolution

10.1 Informal Resolution

In the event of any dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. Please contact us at [email protected] to initiate this process.

10.2 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any legal proceedings must be brought in the courts of Kuala Lumpur, Malaysia, and both parties consent to the exclusive jurisdiction of these courts.

10.3 Mediation

If informal negotiation fails, both parties agree to attempt mediation before pursuing litigation. Mediation costs will be shared equally unless otherwise agreed.

11. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy and Malaysia's Personal Data Protection Act 2010. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

12. General Provisions

12.1 Entire Agreement

These Terms and Conditions, together with your signed rental agreement and any written amendments, constitute the entire agreement between you and Amberveil regarding the rental services.

12.2 Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Amberveil.

12.4 Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations to any entity as part of a merger, acquisition, or sale of assets.

12.5 Notices

All notices must be in writing and delivered via email to the addresses provided in the rental agreement or via registered mail to our office address. Notices are deemed received when acknowledged or three business days after mailing.

13. Amendments to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Material changes will be communicated to active clients via email.

Existing rental agreements will continue under the terms agreed upon at the time of signing unless both parties agree in writing to adopt new terms. New bookings will be subject to the current version of these Terms and Conditions.
